Copyright Agency was appointed by the Australian Government in 1990 to manage the provisions in the Copyright Act that allow educational institutions to use text and images without a copyright clearance, in return for fair payment to the creators and publishers of that material.
These provisions, known as the educational statutory licence, allow the use of almost all text and images, both printed and digital, for a range of educational purposes. They include scanning, printing, photocopying, storing on learning management systems, emailing, distributing via USB, altering and compiling with other resources. The statutory licence thus enables teachers to compile resources to meet learning outcomes from a range of sources that include books, journals, newspapers and material published online.
We use surveys completed by teachers to identify the creators and publishers whose works are used. We then use that information to allocate payments to creators and publishers from the copyright licence fees we collect.
Some material is available to teachers to use without reliance on the educational statutory licence such as material covered by a Creative Commons licence. Our processes include a range of mechanisms to identify that material.
